Scope and Purpose of Collection, Processing, and Use of Personal Data

What Personal Data We Collect
We may collect your reference data (e.g., company name, name, address, email, etc.), personal data regarding the services you use, your payment data, online preferences, and customer feedback. We use this personal data for communication with you, for concluding and processing transactions with you, for operating the Technology, for billing, market research, and marketing purposes, such as analysing our customer base or contacting you via mail, email, or text messages.

We may collect personal data about your creditworthiness to protect ourselves from payment defaults.

Additionally, your browsing and usage data is collected. This includes, for example, your IP address, information on which device, browser, and browser version you used to visit the Technology and when, which operating system you use, from which website or application (“App”) you accessed our Technology via a link, and which elements of the Technology you use and how. This personal data is stored together with the IP address of your access device. It serves to display and optimize our Technology correctly, protect against attacks or other legal violations, and personalize the Technology for you.

When Visiting www.kulm.com

When visiting our website, our servers temporarily store each access in a log file. The following user and device data, as well as personal data, are collected without your intervention and stored by our hosting provider (ISP – Internet Service Provider):

  • the name and URL of the retrieved file

The collection and processing of this data are carried out to enable the use of our website (connection setup), to ensure the security and stability of the system over the long term, to optimize our internet offering, and for internal statistical purposes. This constitutes our legitimate interest in data processing. The IP address is particularly used to identify the country of residence of the website visitor. Furthermore, the IP address is analysed for statistical purposes in the event of attacks on the network infrastructure of www.kulm.com. Additionally, we use pixels and cookies when you visit our Technology to display personalized advertisements and to use web analytics services.

Use for Registration and Security Purposes, as well as Technical and Physical Access Controls

To use certain services and offerings (e.g., Wi-Fi), you must register (either directly with us or through our external login providers), and we process data for this purpose. We also collect additional personal data during the use of the service or offering. We continuously review and improve the appropriate security of our IT systems and other infrastructures (e.g., buildings). We process data, for example, for monitoring, controls, analyses, and tests of our networks and IT infrastructures, for system and error checks, for documentation purposes, and as part of backups. Access controls include physical access control and, in some cases, access to electronic systems. For security purposes (preventive measures and incident investigations), we also maintain access logs or visitor lists and use surveillance systems (e.g., security cameras). At relevant locations, we indicate surveillance systems through appropriate signage. For this purpose, we process registration data, technical data, and other data categories mentioned in Section 3.

Use for Compliance with Laws, Directives, and Recommendations from Authorities, as well as Internal Regulations (“Compliance”)

As part of legal compliance, we may process personal data (e.g., anti-money laundering, tax obligations, reporting of foreign guests to the cantonal foreign police, or implementing health safety protocols). Data processing may also occur in the context of internal investigations or external investigations (e.g., by law enforcement, regulatory authorities, or appointed private entities). For this purpose, we primarily process master data, contract data, and communication data, and, in some cases, behavioral data, technical data, and data from other categories. The legal obligations may include Swiss law, foreign regulations we are subject to, self-regulation, industry standards, corporate governance, and official instructions or requests.

Use for Risk Management and Corporate Governance

In the context of risk management (e.g., protection against criminal activities) and corporate governance, including operational organization (e.g., resource planning) and business development (e.g., acquisition or sale of business units or companies), we may process personal data. For this, we primarily process master data, contract data, registration data, and technical data, as well as behavioral and communication data.

If You Apply for a Position with Us

We collect and process the necessary data to evaluate your application, conduct the application process, and, in the case of successful applications, prepare and finalize a corresponding contract. For this purpose, we primarily process master data and applicant data.

Use of Your Data for Advertising Purposes

Creation of Pseudonymized User Profiles
To enable personalized marketing in social networks, we use so-called remarketing pixels on the Technology. If you have an account with a social network included in this process and are logged in at the time of your visit, this pixel will link the page visit to your account. You can adjust additional advertising settings within your user profile in the respective social networks.

We use re-targeting technologies. These analyse your usage behaviour on our Technology to provide you with personalized advertisements on partner websites. Your usage behaviour is recorded in a pseudonymized manner. Most re-targeting technologies work with cookies. You can prevent re-targeting at any time by rejecting or disabling the relevant cookies in your web browser’s menu. Additionally, you can apply for an opt-out for the mentioned advertising and re-targeting tools via the Digital Advertising Alliance website at optout.aboutads.info.

Adwords and Doubleclick

We use Google AdWords Remarketing and DoubleClick by Google, services provided by Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland (Company Registration Number: 368047), to display ads based on visits to previously viewed websites. For this purpose, Google uses the so-called DoubleClick cookie, which enables recognition of your browser when you visit other websites. The information generated by this cookie about your use of our Technology (including your IP address) is transmitted to and stored on a server operated by Google in the USA (additional details about data transfers to the USA can be found below in the section “Transmission of Personal Data Abroad”).

Google uses this information to evaluate your use of the Technology in relation to the displayed advertisements, to compile reports on website activities and advertisements for website operators, and to provide other services related to website and internet usage. Google may also transfer this information to third parties where required by law or where such third parties process the data on behalf of Google. However, under no circumstances will Google associate your IP address with other data stored by Google.

Google Tag Manager

We also use Google Tag Manager to manage services related to usage-based advertising. The Tag Manager tool itself is a cookie-free domain and does not collect any personal data. The tool merely triggers other tags, which in turn may collect data (see above for details). If you have deactivated data collection at the domain or cookie level, this deactivation will apply to all tracking tags implemented through Google Tag Manager.

Disclosure of Data to Third Parties

We disclose your personal data if you have expressly consented to this, if a legal obligation exists, or if it is necessary to enforce our rights, particularly to enforce claims arising from the relationship between you and AG GRAND HOTELS ENGADINERKULM (e.g., collection agencies, authorities, or lawyers).

We disclose your data to third parties to the extent necessary for the use of the Technology, such as for providing the services you request (e.g., outsourcing partners; hosting providers; companies with which we offer services on our Technology, e.g., for bookings, rentals, purchases, etc.; or companies conducting advertising on our behalf) and for analysing your user behaviour.

When disclosing data to third parties, we ensure that there are adequate contractual guarantees to ensure that such third parties use personal data in compliance with legal requirements and exclusively in our interest.

Transmission of Personal Data Abroad

AG GRAND HOTELS ENGADINERKULM is authorized to transfer your personal data to third-party companies (commissioned service providers) abroad, provided this is necessary for the data processing described in this Privacy Policy. These companies are bound by the same level of data protection obligations as we are. If the level of data protection in a country does not correspond to that of Switzerland or the European Union, we ensure contractually that the protection of your personal data with the recipient always meets the standards applicable in Switzerland or the EU.

Please also note that data exchanged over the internet is often routed through third countries. Therefore, your data may be transferred abroad even if the sender and recipient are in the same country.

Note on Data Transfers to the USA

For the sake of completeness, we inform users residing or established in Switzerland that US authorities conduct surveillance measures that generally allow the storage of all personal data of all individuals whose data has been transferred from Switzerland to the USA. This occurs without differentiation, limitation, or exception based on the objective pursued and without any objective criteria that would limit the US authorities’ access to the data and its subsequent use to specific, strictly limited purposes that justify the access and associated interference with the data. Furthermore, we point out that individuals from Switzerland have no legal remedies in the USA that would allow them access to the data concerning them or to have it corrected or deleted, nor is there any effective judicial protection against general access rights by US authorities.

The exchange of data between the USA and Switzerland, or the EEA/EU, is based on a secure exchange, provided that US companies are certified.

Data Security

We use appropriate technical and organizational security measures to protect your personal data stored with us against manipulation, partial or complete loss, and unauthorized access by third parties. Our security measures are continually improved in line with technological developments. You should always treat your information confidentially and close your browser window once communication with us has ended, and, if necessary, clear the cache, especially when sharing the computer with others.

We also take internal company data protection very seriously. Our employees and the service providers we engage are obligated to maintain confidentiality and comply with data protection regulations.

The website www.kulm.com contains links to third-party websites that may be of interest to you.

AG GRAND HOTELS ENGADINERKULM has no control or influence over these websites, their content, offers, availability, or the data protection policies and regulations that apply there. Therefore, we disclaim any liability.

Cookies

We use cookies in our Technology. Cookies help in many ways to make your visit to our website easier, more pleasant, and more meaningful. Cookies are information files that your web browser automatically saves to your computer’s hard drive when you visit our website.

Session cookies are used to associate server-side stored information uniquely with you or your internet browser during a particular session on our website (e.g., in the online shop so that the shopping cart content is not lost). Session cookies are deleted after you close your web browser.

Persistent cookies are used to save your preferences (e.g., preferred language) across multiple independent visits to our website, i.e., even after closing your web browser, or to enable automatic login. Persistent cookies are deleted according to your web browser settings (e.g., one month after your last visit).

By using our website and the corresponding features (e.g., language selection or auto-login), you consent to the use of persistent cookies.

Cookies do not damage your computer’s hard drive, nor are personal data of users transmitted to us through these cookies. For example, we use cookies to better align the information, offers, and advertisements displayed to you with your individual interests. The use of cookies does not result in us obtaining new personal data about you as an online visitor.

Most internet browsers accept cookies automatically. However, you can configure your browser to ensure that no cookies are stored on your computer, or that a message always appears when you receive a new cookie. Disabling cookies may mean that you will not be able to use all the functions of our website.

Tracking Tools

On our website, we use tracking tools. These tracking tools monitor your browsing behavior on our website. This observation is carried out for the purpose of designing the website according to your needs and for the continuous optimization of our website. In this context, pseudonymized user profiles are created, and small text files stored on your computer (“cookies”) are used.

Third-party service providers may also use persistent cookies, pixel tags, or similar technologies for this purpose. The third-party service provider does not receive any personal data from us but can track your use of our website, combine this data with information from other websites you have visited (which are also tracked by the third-party service provider), and use this information for its own purposes (e.g., to control advertising). The processing of your personal data by the third-party service provider is then carried out under the responsibility of the service provider and in accordance with their data protection policies.

If you agree to the use of Google Analytics, you consent to the transfer of personal data (in particular, usage data related to the website and app, device information, and individual IDs) to the USA and other countries where your data may be accessible to authorities that are not subject to adequate data protection regulations. Information about Google Analytics’ data protection can be found here, and if you have a Google account, you can find further details about Google’s processing here.

Automated Decision Making / Profiling

We (or third parties commissioned by us) generally do not make automated decisions that affect your personal data or have legal effects on you or significantly impact you in a similar manner.

Legal Grounds for Processing

The legal grounds for processing personal data by us are based on the processing of data in direct connection with the conclusion or execution of a contract; on the consent of the data subject; or a legal obligation to process, or it is based on our legitimate interest. In cases where we wish to refuse to enter into contracts with individuals in the future due to abuse, payment defaults, or other similar legitimate reasons, we reserve the right to retain the names, first names, addresses, and email addresses of a data subject, as well as personal data related to the circumstances of the case for our own interest.

Your Rights

Upon request, we provide any affected individual with information about whether and, if applicable, which personal data about them is being processed (Right to confirmation, Right to access). Upon your request:

  • We may partly or entirely refrain from processing personal data (Right to withdraw your consent to the processing of non-essential personal data; Right to erasure). We will also inform third parties to whom we previously forwarded your personal data about your request for erasure.

Submitting a Request to Exercise a Right

To submit a request to exercise any of the rights described in this section (e.g., if you no longer wish to receive our email newsletters or want to delete your account), please use the relevant function on our website or contact our Data Protection Officer or a staff member as indicated at the beginning of this Privacy Policy. If we do not comply with a request, we will inform you of the reasons for this. For example, we may lawfully refuse to delete data if your personal data is still needed for the original purposes (e.g., if you are still receiving services from us), if the processing is based on a mandatory legal basis (e.g., legal accounting regulations), or if we have a legitimate interest (e.g., in the case of a legal dispute with the data subject). If we assert a legitimate interest in processing personal data, you have the right to object to the processing, provided that, in comparison to other data subjects, there is a different balancing of interests due to your particular situation (Right to object). This may be the case if you are a person of public interest or if the processing poses a risk that you may be harmed by third parties. If you are not satisfied with our response to your request, you have the right to file a complaint with the competent supervisory authority, for example, in your country of residence or in Switzerland, with the Federal Data Protection and Information Commissioner (EDÖB) (Right to complaint).

We process personal data only as long as necessary for the respective purpose or as required by law. If you have created an account with us, we will retain the master data provided for the account for 20 years after the last contact. However, you may request the deletion of your account at any time (see the section “Your Rights”). For orders without an account, your master data will be deleted after the warranty period or the completion of the service. We will delete the master data unless we are legally required to retain it. This deletion may be immediate or carried out as part of periodic deletion cycles.

Contract data, which may also include personal data, is retained by us for the duration of the legal retention obligation of 10 years.
